3. Why We Use Your Data
We use your personal data for the following purposes:
To deliver our services. Processing your booking request, preparing quotations, coordinating with carriers, confirming journeys, and managing any changes or issues during your trip.
To share with your assigned carrier. As a disclosed agent, BCS transfers necessary data — such as passenger names, contact details, and journey information — to the carrier performing your transportation. This transfer is required to execute your transportation contract and takes place on the legal basis of contractual necessity.
To communicate with you. Sending booking confirmations, operational updates, invoices, and responding to your enquiries.
To send marketing communications. With your consent, we may send you information about our services, travel updates, or special offers. You can withdraw consent at any time (see Section 7).
To fulfil legal obligations. Retaining records for tax, accounting, and regulatory compliance purposes.
To improve our service. Analysing website usage and booking patterns to make our platform and processes better.
4. Legal Basis for Processing (GDPR)
For customers and contacts in the EU/EEA, we process your data on the following legal grounds:
- Contractual necessity — processing required to fulfil your booking and coordinate your transportation.
- Legal obligation — processing required to comply with applicable laws (e.g. accounting, tax records).
- Legitimate interests — improving our services, preventing fraud, and maintaining security.
- Consent — for marketing communications. You may withdraw consent at any time without affecting prior processing.
5. Who We Share Your Data With
Assigned carriers. As part of every booking, BCS transfers the necessary passenger and journey data to the carrier performing your transportation. This is essential to execute your journey. Carriers receive only the data required for this purpose and are bound by confidentiality.
Service providers. We work with trusted third-party providers for website analytics, email communication, payment processing, and operational tools. These providers access your data only as necessary to perform their services and are contractually bound to protect it.
Legal authorities. We may disclose data where required by law, court order, or to protect the rights, safety, or property of BCS, our customers, or the public.
We do not sell your personal data to third parties.
6. International Data Transfers
BCS is based in the Netherlands (EU). Your data is primarily processed within the EU/EEA.
Where carriers or service providers are located outside the EU/EEA — for example, when a journey takes place in a non-EU country — your data may be transferred internationally. In such cases, we ensure appropriate safeguards are in place in accordance with GDPR requirements, such as standard contractual clauses or equivalent mechanisms.
As most of our customers are non-EU businesses, please note that EU data protection law applies to the data we hold as controller, regardless of where you are located.
7. Your Rights
Depending on your location and applicable law, you may have the following rights regarding your personal data:
- Right of access — you can request a copy of the personal data we hold about you.
- Right to rectification — you can ask us to correct inaccurate or incomplete data.
- Right to erasure — you can request deletion of your data, subject to legal retention obligations.
- Right to restriction — you can ask us to limit how we process your data in certain circumstances.
- Right to data portability — you can request your data in a structured, machine-readable format.
- Right to object — you can object to processing based on legitimate interests or for direct marketing purposes.
- Right to withdraw consent — where processing is based on consent (e.g. marketing emails), you can withdraw at any time by clicking the unsubscribe link in any email or contacting us directly.
To exercise any of these rights, contact us at info@bcs-bus.com. We may need to verify your identity before processing your request. We will respond within 30 days.
If you are located in the EU/EEA and believe we have not handled your data correctly, you have the right to lodge a complaint with your local data protection authority. In the Netherlands, this is the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).
8. Data Retention
We retain your personal data only for as long as necessary:
- Booking and customer data: retained for 7 years after the last transaction to comply with Dutch tax and accounting law.
- Marketing contact data: retained until you withdraw consent or request deletion.
- Website usage data: retained for up to 26 months for analytics purposes.
After the applicable retention period, data is securely deleted or anonymised.
9. Data Security
We take appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, or misuse. These include encrypted connections (HTTPS), access controls, and regular security reviews.
No method of internet transmission or storage is completely secure. While we do everything reasonable to protect your data, we cannot guarantee absolute security.
10. Marketing Communications
By submitting a booking request or enquiry and accepting this Privacy Policy, you may receive service-related communications from BCS (booking confirmations, operational updates, invoices). These are not marketing and do not require separate consent.
With your consent, we may also send promotional communications such as travel tips, special offers, or service updates. You can unsubscribe at any time via the link in any email or by contacting us at info@bcs-bus.com.
11. Third-Party Links
Our website may contain links to external websites. BCS is not responsible for the privacy practices or content of those sites. We recommend reviewing their privacy policies separately.
12. Children
Our services are directed at businesses and adults. We do not knowingly collect personal data from children under 16. If you believe a child has submitted data to us, please contact us and we will delete it promptly.
13. Changes to This Policy
We may update this Privacy Policy from time to time. When we make significant changes, we will notify you by email or by posting a prominent notice on our website. The effective date at the top of this page always reflects the most current version.
Continued use of our services after changes constitutes acceptance of the updated policy.
